“Indômito 360”, S.A.P.I. de C.V. (hereinafter “INDOMITO”) is a company entirely incorporated with Mexican national capital, with its main offices located at Francisco I. Madero Street and Right of Way of the La Paz–Pichilingue Highway, Colonia Colina del Sol, La Paz, Baja California Sur. We are a company dedicated to providing tourism services, such as expeditions and outdoor experiences in the State of Baja California Sur, Mexico.
Therefore, by hiring and enjoying INDOMITO’s services, you agree to comply with and be bound by the following Terms and Conditions:
Use of the Service
Each customer who hires INDOMITO's services, either by making a deposit and/or paying the full amount for the hired service, declares under oath that they appear by their own and personal right and/or through their legal representative; furthermore, they declare that they possess the legal capacity and sufficient personal and economic means to comply with these Terms and Conditions, as it is in their interest to successfully acquire INDOMITO’s services.
It is the responsibility of each customer to provide, at the time of booking any of the tours, the personal data of the final user(s) of the reserved tour so that INDOMITO’s staff can verify their identity when the service is provided, as well as the payment proof for the reservation and/or the full service requested.
Additionally, during the course of the service provision, the customer must comply with the health and safety instructions and recommendations provided by the assigned guide. The customer must also inform the guide about any special needs and/or allergies they may have to ensure the service is provided to their complete satisfaction and in full compliance with the Tourism Law of the State of Baja California Sur and other applicable regulations.
Intellectual Property
Both the client and the end user acknowledge that the ownership of the brand, trade names, logos, slogans, and promotional expressions used by INDOMITO as part of its tourism services—as well as any branded or copyrighted materials—are the sole and exclusive property of INDOMITO. By accepting these Terms and Conditions, the client expressly acknowledges that INDOMITO does not grant, either explicitly or implicitly, any license to use its trademarks or intellectual property registrations for commercialization, transfer, lending, or any other purpose.
Privacy Policy
INDOMITO is responsible for the use and protection of the personal data provided by the client and/or end user, which will be handled with the utmost diligence and confidentiality. Such data will be used for the following purposes, which include but are not limited to:
- To establish direct communication with the client for the offering and promotion of INDOMITO’s services and their full development.
- To formalize and execute the services requested and contracted by the client.
- To provide updated information on INDOMITO’s activities and other services offered.
- For any analogous, compatible, and/or related purpose.
Additionally, INDOMITO may use the client’s and/or end user’s information for the following purposes to ensure and improve service quality:
- To maintain an updated record of clients, suppliers, and end users derived from services provided or quoted by INDOMITO.
- To inform clients (potential and current) about news, advertising communications, and announcements from INDOMITO.
- To use voice and/or image for advertising purposes, corporate image, marketing, advertising campaigns, videos, photography, and publications in any media.
- To send invitations for participation in new tours promoting the development of tourism in Baja California Sur, Mexico.
- To prepare internal reports for service performance monitoring, market segmentation, statistics, records, and data analysis.
- To carry out quality evaluations of INDOMITO’s services to improve client and/or end-user experience.
- To send notifications regarding updates to this Privacy Notice or authorization format for image and voice use.
INDOMITO may also share the information in the following cases:
- When a competent governmental and/or judicial authority, in the exercise of its legal powers, formally requests it, provided that such request is duly substantiated and justified.
- When required by law or in response to a legal process necessary to pursue or defend a legal matter.
Right to Object and Revoke Consent
The client and/or end user may express their refusal to the processing of their personal data for the additional purposes stated herein (except when required by a governmental or judicial authority) by submitting the Negative Response Form, available upon request at administracion@indomito360.com . Such refusal shall not be grounds to deny INDOMITO’s services.
AUTHORIZATION FOR THE USE OF IMAGE, VOICE, AND PERSONAL DATA
By accepting these Terms and Conditions, the client and/or end user grants INDOMITO free authorization to use their image, voice, and/or personal data in videos, audio recordings, photographs, or any other material resulting from their participation in tours, expeditions, or contracted services. Such materials may be used and reproduced, in whole or in part, through any means of communication—such as television, social networks, or other technological platforms—for educational, promotional, informational, or other purposes related to INDOMITO’s activities.
Likewise, the client authorizes INDOMITO to use their image and voice for as long as deemed appropriate by INDOMITO, in full compliance with these Terms and Conditions and the Privacy Policy. This authorization shall remain valid as long as it is relevant to INDOMITO and may be limited by submitting a written request to the Operations Management, following the procedures established for ARCO Rights (Access, Rectification, Cancellation, and Opposition) and/or Revocation of Consent.
This authorization is based on Articles 7 (second paragraph), 9–12, 14–16, 21–34, and 36 of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), effective March 20, 2025; as well as related articles issued by the Secretariat of Anti-Corruption and Good Governance; and Articles 87, 150, and 151 of the Federal Copyright Law (LFDA), and other applicable legislation.
Payment Terms
RESERVATIONS AND DEPOSITS
To confirm a reservation, the client must make a deposit of 50% of the total service amount within two (2) business days after receiving the quotation and confirmation of tour availability.
FULL PAYMENT
After making the advance payment, the customer must settle the remaining 50% (fifty percent) at least 60 (sixty) calendar days before the tour departure date. If the customer makes a reservation within 60 (sixty) days before the service date (tour departure), they must pay the total amount at the time of booking.
All offered prices include local taxes in accordance with the current Mexican tax legislation; any additional charges will be communicated to the customer in advance.
INDOMITO recommends all customers keep their payment receipts as proof in case of any eventuality.
Modification and/or Cancellation of the Service
The following cancellation and refund policies apply to all INDOMITO bookings:
- 100% Refund:: If canceled at least two (2) months before the tour date, INDOMITO will refund 100% of the amount paid, minus an administrative fee of MXN $2,000 per user. Cancellations must be notified in writing to administracion@indomito360.com.
- 50% Refund: If canceled one (1) month before the tour date, INDOMITO will refund 50% of the amount paid. Written notice is also required. administracion@indomito360.com.
- No Refund: No refunds will be made for cancellations made within one month of the tour departure date.
- In the unlikely event that INDOMITO must cancel a tour due to a lack of participantsthe client and/or final users will be notified at least one (1) month in advance of the scheduled date, and 100% of the amount paid to INDOMITO will be refunded. In order to avoid cancellation, INDOMITO may offer the client the option to reschedule the tour for new dates. If the client accepts such rescheduling, no refund will be issued. INDOMITO will not be responsible for any expenses the client may have incurred in preparation for the trip, such as transportation tickets, transfers, or any other non-refundable costs, personal equipment purchases, or similar expenses.
- Port Closure: We understand that the weather can be unpredictable, and our travelers’ safety is our priority. If the La Paz Port Authority decides to close the port due to adverse weather conditions before or during your experience, we will adjust the itinerary to ensure your well-being, whether by advancing or delaying the trip’s start or end. INDOMITO will cover one additional night of accommodation and corresponding meals to ensure your comfort. If it becomes necessary to extend the stay beyond one night due to the same cause, we will unfortunately be unable to cover these additional costs, although we will be happy to assist with logistics.
- Force Majeure: In the event that a tour must be rescheduled due to unforeseen circumstances or force majeure — such as port closures, extreme weather conditions, pandemics, sociopolitical conflicts, or other similar situations that prevent the tour from taking place on the originally scheduled date — and such change affects the client’s stay by more than one night, INDOMITO may propose new dates for the tour. In such cases, no refunds will be issued to the client.
Any additional expenses incurred as a result of the rescheduling — including lodging, transportation, or extra services for days outside the original date — shall be fully covered by the client.
SPECIAL TERMS FOR PRIVATE GROUPS
Private group trips may be subject to different terms and conditions. It is recommended to consult directly with our team for specific information regarding applicable cancellation and refund policies for such cases.
TRAVEL INSURANCE RECOMMENDATION
INDOMITO strongly recommends that all customers purchase travel insurance to protect their investment and cover potential cancellations due to unforeseen circumstances. Adequate insurance can provide peace of mind in case of changes in plans.
Risks Associated with INDOMITO’s Services
By participating in the tours, expeditions, and/or services hired by the customer and/or enjoyed by the final user, INDOMITO informs you of the following risks associated with these activities and advises you to take the recommended precautions:
- Hypothermia: Continuous exposure to weather and ocean conditions can cause hypothermia.
- Recommendations: Follow the instructions provided by the assigned guide and wear appropriate clothing for the contracted activity.
- Heat Stroke. Due to continuous exposure to the sun and dehydration.
- Recommendations: Follow the instructions provided by the assigned guide, drink sufficient amounts of potable water during and after the contracted activities, and use sunscreen at all times.
- Injuries, abrasions, stings, and/or bites. Risk identified during tours, expeditions, and outdoor activities in the Baja California Sur region due to interactions with local flora and fauna.
- Recommendations: wear suitable and durable footwear for land and water, stay alert, and follow the guide’s instructions.
- The customer and/or final user may experience dizziness as part of participating in activities such as kayaking or excursions on uneven terrain.
- Recommendations: follow the assigned guide’s instructions, maintain good hydration, and, if already experiencing dizziness, inform the guide to allow for a rest period.
INDOMITO recommends that you review the specific risks associated with each activity, tour, and/or excursion offered. These can be found in the individual brochures which are initially shared by the sales agent you contacted. By participating in our activities, you agree to be responsible for your own well-being and to follow the recommendations provided by the assigned guide.
SARS-COV2
The client and/or end user is aware of and understands the symptoms, means of transmission, and risks associated with the SARS-CoV-2 virus. Therefore, they acknowledge and accept the risks related to potential contagion arising from interactions that may occur as part of the services contracted with INDOMITO. Consequently, the client releases INDOMITO, its shareholders, directors, agents, guides, and entire staff from any legal, jurisdictional, or medical liability that may arise. Furthermore, the client agrees and accepts that they shall not file any claims, legal actions, or demands for compensation deriving from or inherently related to their participation in the activities associated with the services contracted with INDOMITO, including any acts and/or omissions by INDOMITO’s personnel.
Applicable Legislation and Jurisdiction
These Terms and Conditions shared by INDOMITO, as well as the activities carried out in line with its corporate purpose, business philosophy, mission, and vision, are in full compliance with the General Tourism Law, the Tourism Law of the State of Baja California Sur, the Regulations of the Tourism Law of Baja California Sur, NOM-09-TUR-2002, NOM-12-TUR-2002, and NOM-30-TUR-2006.

ACCEPTANCE OF THE TERMS AND CONDITIONS OF SERVICE OF INDÔMITO 360, S.A.P.I. DE C.V.
The customer and/or final user fully accepts these Terms and Conditions, which were shared prior to hiring INDOMITO’s services. Therefore, the customer agrees to comply with the guidelines set forth herein when hiring INDOMITO.
